Indiana SB 389 – Wetlands Update

SB 389 has cleared both houses of the Indiana legislature and is now heading to the Governor’s desk. For the members of the Indiana Mineral Aggregate Association, the impact of this bill becoming law could be significant.

In summary, this bill will reduce or eliminate the state protection extended to certain classes of wetlands in Indiana.   Between this bill and the Navigable Waters Protection Rule issued in April 2020, the jurisdictional landscape of aquatic resources in Indiana will look very different.  A facility or operation that has not had a jurisdictional determination completed in the last year,  or has put projects on hold because of potential jurisdictional impacts could benefit from an updated assessment.  CEC can provide a more detailed summary of the final version of the bill once it has been signed by the Governor.
